My daughter has chronic medical problems. They don't affect her learning per se, but she is absent a lot. This is a problem since she is in high school and she is penalized for poor attendance. Has anybody in a NYC public school had any success getting an IEP that addresses these issues? When she is in school she gets all A's, but is failing everything because of nonparticipation.
I'm not sure you'd be able to get her an IEP as usually that's for specialized instruction or related services to help her access the curriculum...but I can see maybe getting a 504 (through the ADA) to make accommodations for her... I know that a lot of districts have programs for kids with medical issues to set them up with work at home on days they can't to school. Can you talk to your doctor to get some help with this? Also, ask your schools special education administrator -- maybe s/he can direct you to services...65167
Dear Flowergarden, My first recommendation would be to get a doctor on board with diagnosis letters of your daughter's medical condition. Due to the fact that your daughter does not have any learning disabilities, she will not get an IEP as stated earlier. However, your daughter does have special needs and circumstances that will enable her to be temporarily home schooled. You need to look up these following websites: www.IDEA.ed.gov and www.hhs.gov/ocr/504.html. These two websites will inform you of the federal laws which the Dept of Education (DOE) have to abide by. DOE has Chancellor's regulations to adhere to when a student is temporarily disabled. To have this enforced I suggest you get in contact with Advocatesforchildren.org, 866-427-6033, 212-947-9779 and the Office of Civil Rights at the US Education Department (800) 421-3481 or http://www2.ed.gov/policy/rights/leg/edpicks.jhtml?src=ln. Another resourceful website is kidshealth.org. This should help you to keep abreast with some of the health and physical challenges your daughter now faces as a teenager and the challenges you face as a parent. You are not alone.
